Probates cover the entire process of administering the estate of a deceased person.
Probate involves establishing the legal validity of a deceased person’s will. A deceased person often leaves behind an ‘estate’ which consists of that person’s property and assets/debts. An estate needs to be distributed, usually by an executor, to the beneficiaries named in the will.
If there is a valid will:
The estate will usually be finalised by the executor.
If there is no valid will:
The deceased’s closest next of kin is usually responsible for finalising the estate, and may be appointed administrator of the estate.
